The Readiness Gap: What Hours-of-Service Compliance Can’t Tell You About Your Drivers

Every fleet safety manager knows the drill. Logs are current, the pre-trip is done, the driver is qualified, medically certified, and within their hours. On paper, everything says go.

Here is the uncomfortable question: How many of those fully compliant drivers started their shift in no condition to drive?

COMPLIANCE MEASURES THE FILE, NOT THE DRIVER

The systems most fleets rely on were built to answer specific questions, and they answer them well. Hours-of-service rules confirm a driver had the opportunity to rest. They cannot confirm the driver actually slept. Pre-trip inspections confirm the vehicle is ready. They say nothing about the person climbing into it.

Telematics and cameras tell you what happened after the wheels started turning, which makes them excellent teachers and poor gatekeepers. By the time a lane departure or hard-braking event registers, the impaired driver is already on the road.

None of these tools is broken. They were simply never designed to see the variable that shows up in nearly every serious incident review: the driver’s cognitive state at the start of the shift.

THE SCALE OF THE PROBLEM

Three to seven percent of workers begin their shifts in a high-risk cognitive state, based on field data from more than 250,000 cognitive evaluations in safety-sensitive workplaces. Not over their hours. Not failing a drug test. Simply not ready, whether from a short night, a stressful morning, an illness, or a medical condition they do not yet know they have.

In a 100-driver operation, that is three to seven drivers pulling out of the yard on any given morning carrying elevated risk that no logbook, inspection sheet, or dash cam was built to catch.

Fatigue is the largest contributor, and it is not rare. The National Safety Council estimates that more than 43 percent of workers are sleep-deprived and that those most at risk work night shifts, long shifts, or irregular schedules. That is a description of the driving profession. Research cited by NSC attributes roughly 13 percent of workplace injuries to sleep problems.

SELF-REPORTING IS NOT A SAFETY SYSTEM

Most fleets handle this gap the same way: they ask. A fit-for-duty policy, a supervisor’s glance in the yard, and a culture that encourages drivers to speak up. Those things matter, but they share a weakness.

They depend on a fatigued brain accurately judging its own fatigue, which is precisely the ability fatigue erodes first. Drivers routinely rate themselves fit when objective measures say otherwise, and they are not lying. They genuinely cannot feel the deficit.

Supervisors face the same limitation. This kind of impairment rarely looks like anything at all until the moment it does.

WHAT MEASUREMENT LOOKS LIKE

A newer category of tool, the pre-shift cognitive readiness assessment, closes this gap by measuring rather than asking. The driver completes a short, scientifically validated task on a phone or tablet, lasting about 90 seconds, before the shift begins.

The result is an objective read on reaction time, decision-making, and attention compared with the driver’s own baseline. No diagnosis, no cause assigned, just a clear signal: ready or worth a second look before dispatch.

One of North America’s largest carriers reported 8 percent fewer collisions and a 7 percent reduction in preventable accidents after deploying pre-shift cognitive screening. Across three organizations using this approach, combined annual savings reached $590,000.

The more useful math is your own. Take your fleet’s last preventable collision and count everything it actually cost: the equipment, the cargo, the claim, the premium renewal that followed, the downtime, and the management hours the investigation consumed. Then ask what removing eight out of every hundred of those is worth.

THREE QUESTIONS WORTH ASKING

  1. If a driver arrived tomorrow with four hours of sleep and a clean logbook, would anything in your current system catch it before dispatch?

  2. When your incident reviews cite “driver inattention” or “fatigue,” what evidence do you actually have about the driver’s state at the start of that shift?

  3. Does your fit-for-duty policy rely on drivers and supervisors noticing impairment, or on anything that measures it?

The next frontier of fleet safety is moving from systems that document what a driver did to systems that understand whether a driver was ready.

CVSA BRAKE SAFETY WEEK SCHEDULED FOR AUGUST 23–29

This year’s Brake Safety Week is scheduled for August 23–29, according to the Commercial Vehicle Safety Alliance (CVSA).

The enforcement campaign is part of the larger Brake Safety Awareness Month, which takes place in August.

During CVSA’s annual enforcement event, roadside inspectors will focus on brake systems and components as they conduct North American Standard Inspections, with a particular focus on brake drums and rotors this year.

The association will issue a report on its findings later this year.

The event is also an opportunity for motor carriers to educate drivers and maintenance service providers on the importance of brake safety.
